Political turmoil continues, final say from SC awaited

ITANAGAR, Jan 13: The political uncertainty continues in Arunachal with two major verdicts coming in from Gauhati High Court and Supreme Court, issued on Wednesday.

The Gauhati high court issued a verdict in favour of Arunachal Pradesh Legislative Assembly deputy speaker TN Thongdok's application for vacation of December 17 court order of keeping in abeyance of Arunachal governor order to advance  the legislative session. Based on the Court verdict,  the proceedings of sixth assembly session of December 16-17  which saw the Arunachal Pradesh Legislative Assembly Speaker Nabam Rebia removed and Chief Minister Nabam Tuki losing the  floor test as chief minister stands valid.

However, the Supreme Court is expected to start hearing from Thursday on pleas arising out of orders of the Gauhati High court.

“Having heard counsel for rival parties, we are satisfied, that it would be just and appropriate, if proceedings of the Assembly are not held from now onwards till January 18, 2016”. The Legislative Session was to be held on Jan 14.

The AP Legislative Session meanwhile has to be convened by January as per the Constitutional empowerment which states that there should not be more than a six-month gap between two sessions. The last session of the legislative assembly was held in July.

 

 

MLAs demand CBI investigation in kidnapping case

ITANAGAR, Jan 13: Saying that they have lost faith in the State Police, MLAs Thanwang Wangham, Honchun Ngandam and Gabriel D Wangsu in a joint press statement demanded that the Panngam Ngandam kidnapping case be handed over to Central Bureau of Investigation (CBI) for an impartial inquiry.

Under the current situation, we have lost faith in state police who are denying even to register the FIR, they said.

They also appealed to the Govt. of India to depute a team of National Investigating Agency (NIA) to investigate the case.

They said that Panngam Ngandam, who was reportedly kidnapped by a cadre of NSCN (K) on December 31, 2015 is still not released even after 12-days of his kidnapping.

They alleged that the state Home Department and the police are not serious about the kidnapping case. The police are reluctant even to register the FIR filed by the relatives of the victim on January 7 saying that there is an instruction from the police headquarters, Itanagar not to register the case, they claimed.

As per media report, they said, Tuki had refuted his involvement in the case and called for a high level enquiry to unearth the truth behind the kidnapping. If he is true to his words and want to prove his innocence then he should allow the police to register the case and investigate it without disturbing the process, they said.

 

 

100 days job guarantee under MGNREGA for all: Ering

ROING, Jan 13: Member of Parliament Ninong Ering said he would approach the central government for providing sufficient fund under MGNREGA to ensure 100 days employment guarantee in a financial year to every household under the programme.

Ering, who chaired the District Level Vigilance and Monitoring Committee Meeting here yesterday, stated that he would find out the reason of not providing 100 days job to every household in a year under MGNREGA and take up the matter with the central government.

He urged the state Government to review the fund sharing pattern between Central and state for better performance of the centrally sponsored scheme. He suggested for direct allocation of fund to district authority.

He also suggested that the District authority should be allowed to procure CGI sheets under IAY to maintain quality. He also said that he would personally visit all the beneficiaries under IAY to take stock of quality and quantity of CGI sheets provided to them.

Lower Dibang Valley Deputy Commissioner Ravi Dhawan suggested that works to be taken under MGNREGA should be planned properly and said that individual scheme like IHHL should be taken on priority to benefit the beneficiaries directly.

He also stressed the need for creating mass public awareness about various insurance schemes sponsored by the central Government like Jan Dhon Yojna, Atal Pension Yojna and Bima Yojna, He further informed that all bank branches have been directed to support all the stakeholders to open bank account.

He also stressed on seeding of Aadhar Card with all Job card holders under MGNREGA and directed all BDOs to complete the process by the end of March this year.

The meeting was attended by DRDA Project Director, Executive Engineers of PHED, RWD, Power, Deputy Director of ICDS, public leaders and other officials. DIPRO

 

 

HTS bills cleared in accordance with Centre’s directive

ITANAGAR, Jan 18: Department of Food & Civil Supplies has said that genuine Hill Transport Subsidy [HTS] Bills are being entertained purely in accordance with the Govt of India's directions which specifically states that for the period from April 2010 onwards, the payment for HTS Bills shall be paid on the basis of HTS carriage rates fixed by the Deputy Commissioners through tendering process and without adopting prior approval of Govt of India.

The Bills for the period from 2010 onwards are being processed by the Department of Food & Civil Supplies subject to availability of funds and due verification by the Deputy Commissioners as the State Government has to make payment to the contractors and thereafter re-imbursement has to be sought from the Food Corporation of India.

Deputy Commissioners have to submit HTS Bills to the Directorate of Food & Civil Supplies within six weeks of lifting of food grains from the FCI godowns and the Directorate is mandated to clear the Bills within three months and submit the same to the FCI for re-imbursement, the dept clarified. The department further said that there is no scarcity of food grains in any district.

 

 

State gears up for IPPI

DC bats for involvement of GBS & PRI members for successful conduct of IPPI

BOMDILA, Jan 13: West Kameng Deputy Commissioner AK Singh advocated for involving Gaon Burahs and Panchayat members for higher rates of immunization coverage during the first of Intensified Pulse Polio Immunization (IPPI)

The Deputy Commissioner, who presided over the District Task Force Immunization meeting of the District Health Society today, observed that besides the involvement of the concern administrative officers, the involvement of the GBs and the PRI members of the area would facilitate for achievement of higher target in the first round of the IPPI scheduled on January 17.

Though the immunization coverage of the district was 83 percent in the last quarter, Singh expressed concern over low performance of immunization in certain pockets of the district, especially in areas like Rupa and Singchung blocks. He directed District Task Force to engage the ASHAs to carry out the head counts of children of age 0-5 years children in their respective areas and the result be tallied with the similar counts made by the AWWs.

He also asked the DMO to ensure that the IEC materials and other logistic support from the state are received well in advance and that the process for collection of data of the immunization and the JSY of the Military Hospital Dahung initiated for which he would liaise with the GOC 5-Mtn Div, he assured.

Earlier, the DMO highlighted the aims and objectives of the meeting. The DRCHO reviewed the immunization performance of the last quarter. The micro plan for the first round of IPPI to be held on January 17 was also highlighted.

Among others, the meeting was attended by the administrative officers, MO In-charges of all the CHCs, PHCs, NHM staffs and the DD ICDS. DIPRO

Ziro: A meeting of the District Task Force for Intensified Pulse Polio Immunization was held under the chairmanship of DC Kanki Darang to strategize and mobilize logistic support to carry out the immunization program on Jan 17 next at his office chamber here today.

Addressing the meeting, the DC said that the IPPI program is a massive one with a target to immunize 5656 children between 0-5 yrs, setting up of 128 IPPI booths and requirement of over 500 trained manpower. While assuring to extend all possible support to the exercise, Darang suggested an intensified AIR program with subject matter specialist on IPPI for better outreach and achievement of the target immunization.

Giving special emphasis on vehicle requisition, he sought cooperation from all the HoDs and directed TPT in-charge Hage Tarung to mobilize the requisition of vehicles for the progam.

Presenting the district plan for IPPI, DFWO Derin Likar informed that a 892 strong member team would cover the 128 IPPI booths across the district on Jan 17 next. Our neighboring countries are yet to be polio free and the probability of polio virus through migrants cannot be over looked, therefore a high quality pulse polio supplementary immunization program, intensified routine immunization and intensified AFP surveillance particularly among migrants and high risk areas is necessary to avoid the resurfacing of this crippling disease, Dr. Likar added. House to house activity would also be conducted on Jan 18 next to immunize for children left out on the booth day.

DMO Dr. Moli Riba, ADC Nending Chatung, Deputy Director ICDS Jaya Jawal, AIR Station director Hage Tachang also attended the meeting.

A similar meeting was also held at the conference hall of ZPC office, Yupia, Papum Pare district today.

Papum Pare District Superintendent of Police PN Khrimey exhorted the doctors to work with full vigour to make the district and the state polio free.

District Medical Officer Dr. S. Ronya shared his views on immunization programme.

DRCHO Dr. J.Ado informed requested the medical officers in-charges to submit their micro-plan of respective areas with accurate data.  

Resource person Dr.Tage Taka, Surveillance Medical Officer (SMO),WHO elaborated on district workshop on National Immunization Day (NID) 2016 through PowerPoint and highlighted the status of immunization in Papum Pare district. He informed the WHO has removed India from the list of countries with active poliovirus transmission. India is certified polio free on March 27, 2014, but the battle against polio is not yet over as the virus is still active in our neighboring countries, including Pakistan and Afghanistan, where the cases of polio are being witnessed, he said.

Papum Pare being the capital district  falls under high risk area and  stressed on proper monitoring,  planning and holistic approach  to make the immunization successful.

Governor, CM conveys festival greetings

ITANAGAR, Jan 13: Governor of Arunachal Pradesh JP Rajkhowa and Chief Minister Nabam Tuki wished people of the State as well as Assam on the joyous occasion of Makar Sankranti and Magh Bihu, also known as Bhogali Bihu of Assamese community.

In his festival message, the Governor said that Sankranti is a harvest festival celebrated in almost all parts of the country. He said that the day is very important for Arunachal Pradesh as large number of pilgrims come to Parasuram Kund in Lohit district to take holy dip in the sacred ‘kund’ and offer prayers. A dip on Makara Sankranti day is considered sacred.

While welcoming devotees and pilgrims to Parasuram Kund on the occasion, the Governor offered his prayer for safe and secure holy dip at the Kund. He also advised the district administration and organizers to ensure all comfort and convenience for the pilgrims.

The Governor in his message added that the festivity of Makar Sankranti also coincides with Magh Bihu, a harvest festival of Assam, which marks the end of harvesting season. Chief Minister Nabam Tuki has extended warm greetings on occasion of Magh Bihu as well as the holy festival of Makar Sankranti.

In a message this evening, the Chief Minister expressed the hope that the celebration would usher in a new year of happiness, peace and prosperity for all.

The Chief Minister also greeted the people on the holy occasion of Makar Sankranti, which is celebrated by various names across the country.

“As the festival is dedicated to the Sun God, I pray Almighty Donyi to bestow its choicest blessings on the people of Arunachal Pradesh and protect them from all evils,” Tuki added in his message.

 

 

Incentives enhanced

ITANAGAR, Jan 13: The Arunachal Pradesh Govt has enhanced the rate of incentives to the bonafide Arunachal Pradesh Schedule Tribe candidates for qualifying combined Civil Service Preliminary Examination being conducted by Union Public Service Commission from Rs. 30,000 to Rs. 1,00,000 only with retrospective effect from 2015.

However, the rate of incentives to the APST candidates for qualifying UPSC Mains Examination amounting to Rs. 50,000 shall remain the same, according to an official release.

 

 

AAPPTF demands cancellation of licence to mini melas

ITANAGAR, Jan 13: All Arunachal Pradesh Public Transport Federation (AAPPTF) on Tuesday last submitted a memorandum to Capital Complex DC Mige Kamki with regards to the mushrooming of ‘mini melas cum Chitrahaar’ in every nook and corner of the Capital complex area.

The federation in its memorandum, apprised the DC that the so called mini melas are indulging more on open gambling rather than entertainment activities. These mini melas in the garb of entertainment has become more of a gambling hub which is not permissible, AAPPTF said, and demanded immediate cancellation of licence/permit given to them to organize such melas.

Also putting forward the grievances of beef lovers, the federation highlighted that though the price of a kilo of beef meat was approximately Rs 180 in retail and Rs 140 in wholesale, many restaurants were charging huge amounts for serving beef which was not justified. A representation for the same was placed before the EAC, Naharlagun but there had been no follow up action, the APPTF wrote.

The AAPTF was led by its President Dobing Sonam and General Secretary Gyamar Talik on the occasion.

 

 

Arunachal emerging as major rubber producer

ITANAGAR, Jan 13:  Tokong Pertin, Director of Trade & Commerce informed that going by the present trend of rubber cultivation, within 10-15 years, Arunachal will emerge as leading rubber producing state of the country. He said this during a meeting with Additional Rubber Production Commissioner (Addl. RPC) K Mukundan Pillai, Rubber Board Zonal Office, Guwahati, who is currently on his maiden visit to the Arunachal Pradesh today and Likha Maj, chairman, Arunachal Pradesh State Rubber Board (APSRB).

During the meeting Maj took up various issues which need the attention of Rubber Board of India (RBI). Some of the important points raised include training to the local rubber farmers of state, Establishment of Model Rubber Training Centre in Arunachal, subsidies in the form of providing raw rubber roller machines, setting up of Smoke House etc by RBI, exposure tour for the farmers of state, etc.  Pillai assured to look into the points raised by the Chairman, APSRB. He also assured to visit Arunachal Pradesh along with Joint Rubber Production Commissioner in February. Pillai thanked the State Govt. for showing interest in rubber cultivation and expressed his satisfaction over the helping attitude of Trade & Commerce Department to all the Rubber Board offices located in the state. As of now, one Rubber Board Regional Office is established in Itanagar and Field Offices at Namsai, Roing, Pasighat, Ruksin and Naharlagun to assist in technical guidance to rubber farmers of the State.

 

 

Sensitization on ITP held

DAPORIJO, Jan 13: A two-day training programme was conducted at Dumporijo and Giteripa circles of Upper Subansiri to sensitize people on Intensive Training Programme (ITP) by involving and sensitizing villagers comprising of ASMs, GPCs, GPMs, frontline senior block/village level government functionaries, SHG leaders, NGOs, CBOs, youth and village elders which began on Monday last.

As part of the training, village/GP level sensitization-cum-capacity building programme on poverty reduction exercise, village/GP level on cluster basis sensitization on ITP in the indentified core sectors namely, rural livelihood, primary health in rural areas, drinking water and sanitation and education in rural areas under 100% sponsorship of Government of India was also held.

At Giteripa, while addressing the training programme, Dumporijo ADC incharge Tagi Dango appreciated the ATI for providing the much needed training at Dumporijo and requested all present to reap maximum benefit and to involve Gram Sabha members for further implementation of the programme.

Master Trainer-cum-District Training Coordinator (ITP Project), Tamar Baki briefed about the ITP, present PR system and evolution of e-PRI. He also spoke about the need and major objectives of the ITP including important issues and various aspects to be covered including issues and importance of planning process; role and responsibility of Panchayati Raj Institute;  managerial skills in leadership, motivation and team building at workplace and procedure of developmental schemes in the identified core sectors under ITP projects and covered various convergence programme of CSS programme including ‘My Village My Development’ programme under RGPSA etc. (DIPRO)

Labour room inaugurated at PHC Pakoti

SEPPA, Jan 13:  East Kameng ZPC Meyuk Cheda inaugurated the Labour room at Pakoti PHC amidst the presence of DMO Chasen Lowang Mallo, PHC MO incharge Kapu Sopin, ASM Rohit Bayang, PRI, ASHAs and general public here today.

Speaking on the occasion, MO Kapu Sopin informed that the new labour room will benefit pregnant mothers of many nearby villages of Pakoti like Loffa, Lachungyangje, Hambapinda, Kamsha, Richa, Weshi, Tallang, Pachi, Mangkhya, Mebuwa etc. He further lauded the local MLA-cum-Parliamentary Secretary Tourism Mama Natung who provided fund from his MLA LAD for the construction of the labour room.

DMO, Chasen Lowang Mallo also advised the people of the area to cooperate with the medical staffs and ASHA to avail various health facilities. She also directed all ASHA to bring pregnant mothers to hospital for safe delivery.

Defective goods seized from Roing market

ROING, Jan 13: A team of officials of Department of Legal Metrology, Roing conducted massive inspection drive at Roing market and seized various defective goods from various shops and defaulters were booked under Legal Metrology Act 2009 and Arunachal Pradesh Legal Metrology (Enforcement) Rules, 2011.

The officials appealed to the consumers to check the dates of expiry and manufacture, weight and measures before purchasing any commodity from market and also to ask for cash memo. In case of any irregularity, it should be brought to the notice of the District Consumer Forum without any hesitation, they said.

Similar drive will be carried at regular interval under the supervision of the Lower Dibang Valley Deputy Commissioner and violators of any provision of the Legal Metrology Act 2009 and Arunachal Pradesh Legal Metrology (Enforcement) Rules, 2011 would be dealt sternly.

In an another report received from Jotin Linggi, AMDO, Roing three vehicles were seized during the last two days and imposed penalty under the provision of APMMCR 2002 by the Department for illegal extraction of minor minerals from the quarry sites.

The department has realized Rs.1,25,993 as penalty from the defaulters excluding royalty collection by Geology and Mining department, the report further stated. DIPRO

 

 

 

APWSDUs refute allegation

ITANAGAR, Jan 13: All Puroik Welfare Society District Units (APWSDUs) of Kurung Kumey, Kra Daadi, Papum Pare and East Kameng in a joint press statement have denied any irregularity in distribution of CGI sheets under IAY scheme as alleged by All Puriok Welfare Society (APWS).

Terming the allegation as baseless, the APWS four district units claimed that CGI sheets under the housing scheme were distributed to all the beneficiaries by the authorities concerned in presence of village committees, HGBs, GBs and Panchayat members. There has been no complaint from any beneficiary in distribution of CGI sheets, the press statement claimed. It, however, said that distribution of second installment of CGI sheets under the housing scheme in Papum Pare district is still pending.

The district units of APWS appealed to the Chief Secretary not to believe in such ‘baseless’ allegation.

The four district units of APWS further demanded resignation of the APWS president within a week on moral ground.

 

 

GHSS Doimukh to meet GHSS, Ganga in final

ITANAGAR, Jan 13: GHSS Doimukh will play against GHSS Ganga in the final of the district level Subroto Cup Football Tournament of Papum Pare on January 14 at Rono Ground, Doimukh.

GHSS Doimukh entered into the final defeating GHSS Itanagar 3-2 in the semifinal today.

GHSS Itanagar was leading Doimukh 2-1 at halftime. Doimukh had restored the parity through an own goal from the defender of Itanagar in the second half. The Doimukh team scored the winning goal at about four minutes from time.

 

 

 

Poor implementation of scheme alleged

ITANAGAR, Jan 13: In a representation to the state Chief Secretary today, the All Mengio Youth Association (AMYA) has alleged the Department of Horticulture of not implementing the scheme for establishment of large cardamom garden within Mengio circle under TFC scheme 2014-15 as per DPR and appealed to him to initiate stern action against the said department.

The Association claimed that the department had misused funds and not provided essential items like barbed wire, garden tools, suckers of large cardamom and biopesticides etc.

 

 

Check gate inaugurated

ITANAGAR, Jan 13: A check gate was inaugurated by the ADC Seijosa at the strategic point of Jolly and Lanka village under Seijosa sub-division to check illegal forest and wildlife activities.

The check gate has been constructed with the initiative of Tana Tapi, Divisional Forest Officer (W) and Akang Keyang, Chairman, Eco Development Committee, Jolly and Lanka village.

With the setting up of this check gate at this strategic location all vehicles entering the sub-division will have to register themselves in the check gate, which will in turn make sure that no illegal forest and wildlife products are smuggled out of this place.

Speaking on the occasion the ADC advised the villagers to volunteer themselves for conservation of forest resources to reap its positive benefits. A collective effort is needed to make the conservation movement a success, he said.

The ADC urged the gathering to realize the responsibility of preserving forests and wildlife and reminded them about the importance of maintaining the ecosystem for the benefit and survival of all living things.

It is worth mentioning that Pakke Tiger Sanctuary is among the best of its kind in the country and also takes pride of having and conserving four of the endangered hornbill birds due to the concerted efforts of the public in the area.

Cultural progs. mark National Youth Day

ITANAGAR, Jan 13: Colorful cultural programmes marked Swami Vivekananda Jayanti celebrations being organized by the VKV Vivek Vihar at Vivekananda Hall of RK Mission Hospital Compound here on Tuesday.

Addressing the hundreds of students on the occasion as chief guest Capital Complex DC, Mige Kamki highlighted the great deeds accomplished by Swami Vivekananda. He also lauded the VKV and its teaching faculty for their endeavor in providing quality education to the students despite limited resources.

The DC later gave away prizes to the students who took part in various literary and cultural competitions.

 

 

Relief sought for fire victim

ITANAGAR, Jan 13:  Members of Press Colony Welfare Committee Papu Nallah, Naharlagun led by its chairman, Achu Bagang today extended financial assistance to one Tarh Palang whose house was destroyed in a fire incident on Jan 4 last.

The Committee further appealed the local MLA, Techi Kaso and Ward No. 19 Councilor, Kipa Babu to provide immediate relief to the fire victim.  

 

 

ZPM extends gratitude

ITANAGAR, Jan 13:  The ZPM of Lazu block Ngoke Hodong has extended gratitude to all the people who voluntarily helped victim of Lazu village fire incident. In the fire incident, 38 houses were totally gutted into ashes and 23 were partially damaged. The incident took place on 31st December.

 

 

DM prohibits construction of structure along NH

ITANAGAR, Jan 13: The Deputy Commissioner cum District Magistrate of Itanagar Capital Complex, in an order under section 133 CrPC has prohibited construction of new OBT structures within the vicinity of around 50 meter along sides of the National Highway from Holongi to Banderdewa.

All the existing dilapidated fencing, OBT houses/ structures should be maintained properly and kept neat and clean on or before February 1 failing which all such structures, fencings would be dismantled without further notice, the order said. Further, the vacated lands would be handed over to Itanagar Municipal Council for avenue plantations and beautification, the order said.  

The order has been issued in view of construction of unauthorized OBT structures along sides of National Highway from Holongi, Itanagar, Naharlagun to Banderdewa which have become public nuisance besides giving ugly look to the face of the Capital.

 

 

ANSU demands new IO

ITANAGAR, Jan 13: Expressing unhappiness over the manner in which the investigation process into the case against Kalikho Pul is going on, the All Nyishi Students’ Union (ANSU) has demanded the Superintendent of Police (SP) of Capital Complex to change the Investigation Officer (IO) of the case and shoulder the responsibility to an officer of the rank of Deputy SP.

In its complaint letter to the Capital Complex SP, ANSU said that an FIR was filed against Pul at Itanagar Police Station for defaming the Nyishi community. Subsequently, the FIR was registered at U/S 153 (A) (1)/504 IPC. But, there has been no progress made in the investigation, ANSU said, and demanded to expedite the investigation failing which it further threatened to launch a series of democratic movement.

Fire incidents has been repeatedly occurring across the state for the last many years but still we have not been able to find a lasting solution.  Especially places like Daporijo, Ziro valley, parts of West Siang district and few districts of eastern Arunachal are vulnerable to fire accidents.

In the last two months only, four major fire accidents have occurred within the Daporijo Township. The latest being on 11th January when a fire broke out in Rijo Middle School creating panic among the students who were attending classes. The school suffered major loss as six class rooms were completely destroyed and two partially damaged. In another incident, a massive fire which engulfed Lazu village on December 31st created havoc. Altogether 38 houses were totally gutted into ashes and 23 were partially damaged. People of Lazu village are still struggling to survive and desperately need help of the state government. These are just few examples of how fire accidents are taking place across the state. The authority concerns should try to find out lasting solution. A proper study should be done to find out cause of the fire accidents. Also more funds should be made available to fire service department of APP. This will help them to buy latest equipment and also to hire the required manpower. Lack of education about fire safety is also a major cause for concern. State government should carry out massive awareness campaign in both urban as well as rural areas.

Reminiscing judicial glory of the past

Dear Editor,

The statue of lady of justice standing beautifully in a flowing robe with uneven weighing scales on her right hand, swords on the left and her eyes blindfolded. She adorns every court as the main attraction of the seat of justice. All the three elements symbolically represent the core essence required for delivering justice. The weighing scales are symbolic of various material evidences and facts as alleged, weight and correctness of which to be determined by the wisdom and justness of the court. The sword is said to depict the power and authority to render punishment. The blindfold of the lady of justice denote impartiality, honesty, fearlessness, equality, enforcing rule of law and it does not mean justice is blind or there is no justice as commonly construed by the masses which has become the perception today. Blindfold represents the fact that the justice does not discriminate between the powerful and the poor, mighty and the weak, and would be blind to all such discriminatory factors and she can see with her inner sense of just and fairness based on what is contained in the weighing scales. The judiciary symbolized by Lady of justice is faced with tremendous task in a grave constitutional crises being faced in the “the land of the rising sun” which is undergoing an unprecedented political crises involving important questions of Constitution law. The entire people of the State and the country is eagerly awaiting the final verdict of the court hoping that the true principle and edifice of constitutional norms and propriety will be declared in a certain way and clear the air of uncertainty once and for all. All the affected parties have already presented their respective legal stands and arguments before the honorable High Court. The matter is being keenly followed by all the concerned segments and I have no qualms in stating that whatever the judgment will be it is going to set the precedent on a vital constitutional question concerning the constitutional power and function of an important constitutional functionary known as the Governor. Not that we have no prior related case on the matter but the current case concerning State of Arunachal Pradesh before the honorable High Court of Guwahati is unique and has no precedent clearly applicable on it. That is why the judgment will be a precedent for the future whether for good or bad which only time can tell.

In the past India’s judiciary has always upheld the supremacy of constitution in the face of apparent conflicts between the executive, legislature and governor’s office leading to constitutional crises by exercising judicial review power barring a few aberrations. The judgments like Kesavananda Bharti case wherein the Supreme Court propounded the doctrine of basic structure till today acts as the effective check on the arbitrary acts of the organs of the State. Late justice Hans Raj Khanna who scripted this doctrine in interpreting the parliament’s power to amend the constitution has done a yeoman’s service to the constitution of India. By far the most landmark case in the history of Indian Constitutional law. The case that is said to have saved India’s democracy! Eminent lawyer Nani Palkhivala remarked, “If I could go back in time and witness an event, I would choose to witness the arguments that took place in the Supreme Court in this case! It was a sheer divinity.” In another landmark case on Article 356, S.R. Bommai case the Supreme Court ruled that the test of confidence in the ministry should normally be left to a vote in the Assembly. The verdict as to majority support claimed by a Chief Minister and his Council of Ministers should be left to the legislature. This case made the floor test to show majority mandatory in case of lack of majority and held governor to explore all possibilities to form a stable government before recommending for imposition of Article 356.

However, there are some important lessons to be learnt from every crisis. It is believed much of the legal and constitutional crises could have been averted or diffused with proper understanding of the legal and constitutional implications of the alleged acts. As every political crisis will ultimately become a legal and constitutional one. Politics and law are the life line of political class impacting overall governance. Sound legal and constitutional comprehension based on timely and well advised actions is what strengthens the machinery of governance. In the face of the present crisis, we are reminded of the fact that very essence of power of judicial review is not only to expound and interpret the law but to help in resolving the deadlock and paving way for the best viable solution permissible within the Constitution. Yet another moment of acid test for the judiciary!

BJP’s role

Dear Editor,

Over indulgence of any Governor in the affair of governance will have a long term bearing on any Government in state. Today the Congress is running the Government with peoples mandate, this has to be respected. Tomorrow the BJP may come to power and then you will feel the pinch when this same Governor writes to Directors/Secretaries/Commissioners/CS/Ministers even to Central Government about affairs of day to day management of the Government; as no Government can make roads, drains overnight. Arunachal Pradesh is a full-fledged state and the federal structure of the Indian Democracy should be respected and upheld. We are not following Presidential form of democracy like America where President of USA and Governors of state are directly elected by the people. In India, Governors and President is in spirit and practice a ceremonial Post. Rajbhawan should not be unnecessarily made a political centre, the neutrality, integrity, status and sanctity of Rajbhawan should be maintained as we saw in the past more than two decades.

BJP Leaders are asking for invoking Article 371 H. This will be the blunder respected leaders are committing. This is a volcano sleeping below us. This Article 371 H has to be repealed and BJP is saying to use this Atom Bomb on us? The generation will never forgive you all. Please deeply study the consequence of such an Article (371 H) in a democratic country like India. BJP is saying One Nation One Religion why Not One nation equal treatment to us? Why not article 371 H in all states of India? Why only Arunachal? The BJP leaders have a chance to win the hearts of people by repealing this act in the Lok sabha and also by amending any clause of the statehood Act 1987 which is not in our interest. Irrespective of party affiliation Kiren Rijuju was elected an MP (more on personality). Now it is Kiren‘s turn to do something tangible in the Parliament not just sweet talk! He is most powerful MoS. People have a high hope on Kiren. Now BJP has absolute majority in Lok Sabha, please repeal Article 371 H and also amend other Articles in the AP Statehood Act 1987 for the welfare of people of Arunachal.

I request MoS Home to advice the state BJP MLAs and Office bearers not to go to Rajbhawan just like going to Akasdeep market and complain your petty problems, instead they can go the Ghar- Ghar and tell people against the Congress party and Government, if any. This may bear fruit in 2019 but Rajbhawan has limitations. We are living in 21st century and India is the largest democracy in the world, where a Chaiwala becomes Prime Minister! This is the beauty of Indian Democracy. Please wait till 2019, let us go back to people and get peoples mandate, people will not accept any government by back door policy. If the dissidence is congress internal problem than why BJP MLAs are openly hobnobbing with them? Let our Congress MLAs stay in Delhi or any part of India for as much as long they want ,Congress party is competent to solve the problem. why BJP is worried and creating complications? The Political, Constitutional and Law and order problem in the state is by product of BJPs definition of constitution. Let us all respect the multiparty democracy system in the country. The INC has 47 MLAs, BJP only 11 and 2 Independent. So INC has the mandate with absolute and thumping majority to govern the state for the next five years.
